Limitation of Liability

EFFECTIVE 3 AUGUST 2026

This page sets out the limits of our legal responsibility. It forms part of the Terms of Use. It is written to be understood rather than to intimidate — including the part where we tell you what we can never limit.

WHAT WE NEVER EXCLUDE
Nothing on this page limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected — no term here overrides them, and where a limit below conflicts with a mandatory consumer protection in your country, that protection wins.

1. What TrueTotal is, for the purpose of liability

TrueTotal is a free information service. We do not sell goods, take payment, hold funds, or act as agent for any seller. We publish computed estimates from sourced inputs. Everything below flows from that: our responsibility is for the service we provide, not for the transactions you go on to make with others.

2. No guarantee of accuracy or completeness

2.1Our figures are estimates computed at a point in time, not quotes or offers. We do not warrant that any figure is accurate, current, complete or suitable for your circumstances. See Pricing & Accuracy.

2.2We do not warrant that our coverage is complete. An option missing from a comparison is not a statement that it does not exist or is not suitable.

2.3Data reaching us from third parties may itself be wrong or out of date. We grade and date every input so you can judge it, but we cannot guarantee the underlying source.

3. No guarantee of uninterrupted service

We aim for a reliable, fast service and monitor it accordingly, but we do not warrant that it will be uninterrupted, timely, secure or error-free, or that defects will be corrected. We may change, suspend or withdraw features. See also force majeure in the Terms of Use.

4. Decisions you take

You are responsible for your own purchasing decisions. We ask you, plainly and repeatedly, to verify prices and terms with the seller before you buy. To the fullest extent permitted by law, we are not liable for loss arising from a decision taken in reliance on our estimates, or from a difference between our figure and what a seller actually charges.

5. Third parties

We are not liable for the acts, omissions, content, products, services, availability, pricing or privacy practices of third-party sites and sellers, or for your dealings with them. Your contract on a purchase is with the seller. See Third-Party Links Disclaimer.

6. Excluded loss

To the fullest extent permitted by law, and subject to section 8, we are not liable for:

  • indirect, special or consequential loss;
  • loss of profit, revenue, anticipated savings, business, contracts or opportunity;
  • loss of goodwill or reputation;
  • loss or corruption of data, other than where caused by our breach of data-protection law;
  • loss arising from unavailability of the service or of any third-party site;
  • loss arising from a purchase you did or did not make.

7. Cap on liability

7.1Where liability is not excluded, our total aggregate liability to you arising from or in connection with the service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of: (a) €100; or (b) the total commission we actually earned on your referrals in the twelve months before the event giving rise to the claim.

7.2The service is provided free of charge. That is the context for the cap: there is no fee against which a proportionate remedy could be measured.

7.3Each provision of this section operates separately. If one is held unenforceable, the others continue to apply.

8. Your consumer rights

If you are a consumer, the limits above apply only to the extent the law allows. Under Irish and EU consumer law you keep rights that cannot be excluded or restricted by contract, including the protection of the mandatory laws of your country of residence. You may bring proceedings in your own country’s courts, and you may use the European Commission’s ODR platform at ec.europa.eu/consumers/odr.

Complaints about how we handle personal data can go to the Irish Data Protection Commission (https://www.dataprotection.ie).

9. Business users

If you use TrueTotal for business purposes, you do so at your own risk and the consumer protections in section 8 do not apply to you. We exclude all implied warranties to the fullest extent permitted, and sections 6 and 7 apply without the qualification in section 8.
